DELIVERY

All orders recived before 12 oclock on work days will be shipped out same day. Weekend and holiday orders will be shipped out on next business day. Shipping is done from Estonia based on Estonian business days.

1. VALIDITY OF THE GENERAL TERMS

1.1. The General Terms and Conditions apply to the legal relations arising from the purchase of goods between rockingundies.com customers (hereinafter referred to as the Customer) and the owner of rockingundies.com PW Trade OÜ reg. no. 12036813 (hereinafter referred to as rockingundies.com).

1.2. The General Terms and Conditions cannot conflict with the legal regulations in force in the Republic of Estonia and, if necessary (in case of disputes or missing information), have been supplemented by these regulations.

1.3. In addition to these General Terms and Conditions, the relations between the Customer and rockingundies.com are regulated by established good practices, the price list of products and the Terms and Conditions of Purchase.

1.4. rockingundies.com reserves the right to unilaterally change these terms and conditions and product prices for the purpose of improving the efficiency, competitiveness, further development and replenishment or reorganization of the assortment of goods. Changes and additions to the terms and conditions and the price list shall enter into force from the moment the said information appears on the website. If the Client submitted his order before the changes to the terms and conditions entered into force, the terms and conditions in force at the time of submitting the order shall apply to the Client, unless otherwise provided by law or these terms and conditions.

1.5. rockingundies.com and the Client wish to trade through the rockingundies.com website under the terms and conditions set out in this document. By placing an order on the rockingundies.com website and making an advance payment, the Client confirms that he has read the terms and conditions of sale and agrees with them. ​

2. PRICE LIST

2.1. The prices of the products sold on the rockingundies.com website are stated in euros and a delivery fee is added to them. The prices include 24% VAT.

2.2. The delivery price for rockingundies.com products is indicated for the postal service.

2.3. rockingundies.com reserves the right to adjust prices. If the Customer submitted their order before the price change came into effect, the price that was reflected on the prepayment invoice at the time of placing the order will apply to them, provided that the order has not been canceled for the reason specified in clause 6.1. ​

3. ORDER FORMATION

3.1. The Customer's Shopping Cart is created at the moment they click on the "Add to Cart" button.

3.2. Adding a product to the Shopping Cart does not oblige the Customer to purchase it yet.

3.3. The Customer can change the quantity of products in the Shopping Cart and remove them from the Shopping Cart if necessary.

3.4. The products in the Shopping Cart are also available to other Customers until the order is confirmed.

3.5. When placing the order, the Customer checks whether the Recipient's details are correct.

3.6. The accuracy of the data provided in the order determines the smooth delivery of the products purchased by the Customer and sometimes also possible additional costs. After clicking the "Place order" button, a prepayment invoice will be sent to the Customer's e-mail address.

3.7. The sales contract is considered concluded if the Customer has paid the amount due on the prepayment invoice to the PW Trade OÜ bank account within 24 hours.

3.8. Detailed information on making a purchase can be found under the Terms of Purchase. ​

4. PAYMENT FOR THE ORDERED GOODS

4.1. Once the Customer has confirmed the order, a prepayment invoice will be sent immediately to the e-mail address entered by the Customer, on the basis of which the goods can be paid.

4.2. The prepayment invoice contains the products ordered by the Customer and the contact details to which the order will be sent. The prepayment invoice also contains rockingundies.com details and the bank account to which the payment can be made.

4.3. If the Client has not paid the prepayment invoice to the rockingundies.com bank account within 24 hours of the prepayment invoice being issued, rockingundies.com will consider this as the Client's wish to cancel the purchase and cancel the order. ​

5. DELIVERY

5.1. After the Agreement enters into force in accordance with clause 3.7. of the Terms and Conditions and provided that clause 1.5. has been fulfilled, the products will be delivered to the parcel machine specified by the Client in the order.

5.2. rockingundies.com will send the parcel in a secure envelope via chosen postal service. All orders recived before 12 o´clock will be sent out same business day. All the orders recived over the weekend or holidays will be sent out next business day. The parcel will arrive at the selected parcel machine and the Customer will receive an SMS to the phone number provided to us. If the Customer has not received the shipment or notification within more than 5 business days, we ask that you notify rockingundies.com by e-mail,

5.3 During the promotional campaign, orders will be posted within 9 business days at the latest and the order will reach the Customer within 13 business days at the latest.

5.4. In the event of a change in the destination, rockingundies.com asks the Customer to notify the new information as soon as possible. If the goods have already been posted, changing the destination is no longer possible.

5.5. The accuracy and correctness of the data provided in the order determines the avoidance of delays and misunderstandings in the delivery of the goods to the Customer. rockingundies.com and delivery services are not responsible for delays in the delivery of products and any misunderstandings that may arise if the delay or misunderstanding was due to the inaccuracy of the data provided by the Customer when placing the order. ​​

6. RETURN OF GOODS, WITHDRAWAL FROM THE CONTRACT AND REFUNDS

6.1. rockingundies.com reserves the right to cancel the Customer's order if the Customer has not paid the amount stated on the prepayment invoice to the PW Trade OÜ bank account within 24 hours of the prepayment invoice being issued.

6.2. If the ordered goods arrived at the Customer as defective, which was not immediately identified upon external inspection and which was not present when the package was opened, or if the goods are not what the Customer ordered, we ask that rockingundies.com be informed of this immediately by e-mail. According to § 218 (2) of the Estonian Consumer Protection Act, the Customer has the right to file a complaint within two years from the date of receipt of the goods. If the defect is of a technological nature, the Customer may demand that the product be repaired, and if the repair is impossible or ineffective, the product be replaced or the money be refunded. The complaint must be submitted in writing to the e-shop's e-mail address and describe the defect in the product as clearly as possible.

6.2. rockingundies.com is obliged to respond to the complaint submitted by the consumer in writing or in a form that allows for written reproduction in the same form and to inform about the satisfaction of the consumer's claim or a possible solution to the complaint within 15 days of receiving the complaint, unless another deadline is provided for by law or a European Union regulation. The response to the consumer will be sent to the postal address or e-mail address specified by the consumer, unless otherwise agreed with the consumer. NB! The returned product must not be used and the packaging must not be opened!

6.3. The consumer has the right to file a complaint about the goods within 14 days of receiving the goods. The returned goods must be unused and the packaging must not be opened. All postage costs related to the return and exchange shall be borne by the Customer. In the event of an exchange, rockingundies.com will send a replacement package to the Customer without charging postage. The new goods will arrive at the Customer within 3-5 working days after rockingundies.com receives the returned goods, if the goods are in stock. If the goods are not in stock immediately, rockingundies.com will contact the Customer.

6.4. In the event of deterioration of the returned item, the consumer is responsible for the decrease in value due to use. In order to verify the nature, properties and functioning of the item, the consumer should handle and use the item only in the way that he would normally be allowed to do so in a store. If rockingundies.com is unable to offer the Customer a new product/size/color, the full amount paid for the product in the unopened original packaging will be refunded, excluding delivery costs.

7. LIABILITY AND FORCE MAJEURE

7.1. rockingundies.com is liable to the Customer for any damage caused by rockingundies.com's violation of these terms and conditions in the cases and to the extent provided for in the legislation in force in the Republic of Estonia.

7.2. The Customer is liable to rockingundies.ee for any damage caused by the Customer's violation of these terms and conditions in the cases and to the extent provided for in the legislation in force in the Republic of Estonia.

7.3. Neither party is liable to the other party and its conduct shall not be considered a breach of these terms and conditions due to any delay in performing or failure to perform any of its obligations, if the reason for the delay or failure to perform was beyond the control of the said party (force majeure).

7.4. rockingundies.com does not compensate for moral damage that may be caused to the Customer by changing delivery times, prices and other conditions within the framework of these terms and conditions. ​

8. OTHER TERMS AND CONDITIONS

8.1. rockingundies.com uses the personal data provided by the Customer only to fulfill the Customer's purchase order. rockingundies.com does not disclose information obtained during purchases to third parties, except to Omniva and Smartpost in cases prescribed by law.

8.2. rockingundies.com reserves the right to send the Customer information about new products and special offers if the Customer has subscribed to the rockingundies.com newsletter. The Customer has the right to demand that his/her data be deleted from the rockingundies.com database.

8.3. In matters not regulated by these terms and conditions, the Customer and rockingundies.com are guided by the legislation in force in the Republic of Estonia and other acts regulating the relations between the parties.

 

8.4. The parties shall resolve disagreements and disputes arising from the performance of these terms and conditions primarily through negotiations. If disputes arising from the Agreement cannot be resolved through negotiations between the parties, both the Client and rockingundies.com have the right to turn to the Consumer Disputes Commission operating at the Consumer Protection Board or to a court to protect their rights. The Commission is competent to resolve both domestic and cross-border consumer disputes initiated by a consumer arising from an agreement between a consumer and a trader, one of the parties to which is a trader whose place of establishment is in the Republic of Estonia. 9. FINAL PROVISIONS

9.1. These terms and conditions of purchase and sale and purchase agreements of the rockingundies.com e-store shall be governed by Estonian law. If any provision of the terms and conditions of purchase and sale is void, this shall not affect the validity of the remaining terms and conditions of purchase and sale and purchase agreements. The invalid provision shall be replaced by a lawful provision that is legally and economically closest to the invalid provision.
